Pro rata in a employment contract

Backtoworkffs · 27/01/2023 16:53

So I’ve been offered a job (Uk), the role is part time and the contract says its pro rata in brackets after the salary. All as expected.
The holiday entitlement is just shown as 25 days, nothing said about pro rata. Have HR made a mistake and given me a full holiday entitlement rather than a pro rata one.

Before anyone starts, I will be flagging this if they have made a mistake, I’m not about to steal a load of holiday entitlement.

Does that include bank holidays because that might be the pro rata amount. I’m part time and it is usually specified in hours rather than weeks to avoid confusion.

If you are working 5 shorter days then you would get 25 shorter days holiday.

But my husbands holiday is done in hours as while he works full time it is across different teams. So hours are common for part time work.

Think you need to clarify it with them.

As has been said, it depends on your work pattern, so it's impossible to say right now. What is your work pattern, and what do full-timers get?

If your part-time hours will be worked over 2 or 3 days a week, then 25 days A/L would be wrong. But if you were working short days 5 days a week, then it might be correct.

If you work 5 days a week, your holiday entitlement is the same as for full time staff - you get the same number of days as full time staff but fewer hours because your days are shorter. If you work less than 5 days a week your entitlement should be lower than for full time staff.

Contracted to work 15 hours a week, 2.5 days a week.

bank holidays are shown as extra to the 25 days holiday.

How many bank holidays have they specified?
Do full time staff get 25 days plus bank holidays?

As you do 2½ days you should get ½ of the holidays and ½ of the bank holidays that full time staff get.

It is usual that pro rata stated applies to all relevant terms. It doesn't need to be repeated. But when in doubt, always ask for clarification.

25 days is definitely wrong then otherwise full time staff would get 50 days leave.

You should get 50% of the BH allowance too but it will be a pain if you work Mondays or Fridays because you won’t have enough “BH” hours so will have to use annual leave.

If your contract is 15 hours per week then I'd expect your holiday to be given pro rata in hours as well.

Most companies standard working day is 7.5 hours so when you say 15 hours/ 2.5 days I assume you will be doing 2 days of 6 hours and one day of 3 hours?

If a standard full time contract inludes 25 days holiday then your entitlement should be 25 x 15/37.5 or whatever their standard working week is in hours.

If full time staff get 25 days plus bank holidays, that is 33 days in a normal year (it will be 34 days this year due to the coronation). You should therefore receive half of that - 16.5 days (17 days this year). It could be calculated in hours as the previous poster has suggested, but this is only really necessary for irregular working patterns.
