So, I want to make a claim at the small claim court I am wondering if I have to inform the person that I will be making a claim against them 1st before making the claim.

Yes, if you have not already done so, you should send a formal letter of claim setting out what your claim is for, what its legal basis is (breach of contract, etc.), and what you want (money, repair, etc.), giving them a deadline to respond by. And saying that if you cannot resolve the matter through settlement, you will be left with no choice but to issue a claim in the small claims court.

If they don't pay or don't respond, you then issue the claim.

As @1Wanda1 said, but send it recorded delivery so you can prove it was sent.

As @1Wanda1 says. Have you read the info on the website? It’s quite clear what you need to do.

OP, you will find this guide to bringing a Small Claims Court claim helpful (and the court will expect you to have read it): www.judiciary.uk/wp-content/uploads/JCO/Documents/CJC/Publications/Other+papers/Small+Claims+Guide+for+web+FINAL.pdf

re the formal letter of claim, can that be done by email if you don't yet have their address?

is email as good as post?
