Trouble getting ex (since 2009) to sell joint-mortgaged house.

I'd appreciate anyone's advice/help with the below issues I have with a house I jointly own with my ex of 14 years.

Bought house with partner in 06-2000 for £55000. Joint mortgage.

Had son in 2003.

We remortgaged (with borrowings) a couple of times.

Separated in 2009.

Son (with aspergers) stayed with me 3 nights, 4 days most weeks until 15.
Then just most weekends.
Now, that he's 19 with FT college and PT work, and that he goes out more with friends, he stays 1 night a week with me.

Paid 1/2 mortgage plus maintenance up until 2021, where changed to just half mortgage.

Ex agreed to buy me out in 2021, however she didn't have good enough credit rating (and still doesn't). So it has just been left.

House was due for mortgage renewal end of 2021, as ex was going to buy me out we didn't renew the mortgage. We have been paying the HVR for over a year now (currently 6.49%).

I am now paying about 42% of the mortgage each month. Mainly because I haven't upped my payments with the recent variable rate increases.

I want to now sell the house (19 year old son is more than welcome to stay with me permanently).
With something like a 40%/60% (in ex's favour) split of what's left after all expenses and mortgage paid off.

Ex is upset that she won't have a house, and won't have anything to leave our son. She is not answering my texts/calls about getting the house to a sellable state, so we can get an evaluation from a selection of estate agents.

Apart from Family Mediation when we first split, we haven't sought any legal advice.
I don't have much money to spend on solicitors.

I am now married (6 years) and have a 9yo son.

What advice can anyone give me?

There are 3 things I would ideally like, in this order:

  1. Stop paying £260 a month for the mortgage.
  2. Have name removed from mortgage and remove house from my credit score.
  3. Get the 40% of any monies left after all fees from selling the house.

Mainly the first two. The 3rd can wait.

You won't get the first two without the third if she can't get a mortgage. Your only option is to force a sale of the house.
