Small claims court

Does anyone know...
If I've got to the stage of requesting a CCJ against a defendant in small claims court- will I definitely have to attend court to present evidence, or does the judge decide on written evidence sometimes? If so, when?

Tia!

If the defendant doesn't reply to the claim (ie doesn't file a defence) then you can apply for 'judgment in default' and that is dealt with on paper. If the defendant defends the case then there will be a short hearing before a judge which you (or someone on your behalf) would have to attend and you would need to send in a bundle of relevant documents and your written witness statement in advance. Small claims hearings are quite informal and designed for litigants in person (ie without lawyers).

Have a look on the citizens advice website for guidance on the small claims process.
