Self Employed Sub contractor what’s our rights?

Hiya
the website Hiscox.co.uk states that she would be classed by law as a “worker” or “employee” due to her line of work without adjustments it won’t be safe for her to continue her work.

we think that they won’t make what we would class as resealable adjustments, reason we think they are reasonable is there are other people in the firm who are employed that already have the same adjustments for other reasons such as not working with Covid people

If they do refuse the adjustments there is no other work within the company she will be able todo online it says in that case she should be suspended with full pay but being self employed I don’t see them doing that.

would we have a case for discrimination? What are our rights?

If someone who is self-employed has a disability, any company she works for must make reasonable adjustments. They can refuse to do so if it would be too expensive or disruptive. However, if others already have the required adjustments, it would be hard for the business to argue that these apply. A failure to make reasonable adjustments is likely to be unlawful discrimination.

Check the HMRC cest tool on their website as well to get some more clarification on her status
