Statement for Divorce Absolute

Mybloodycat · 01/12/2022 21:42

How do I write this?
I didn’t apply for the Absolute due to a home rights charge which would have been removed if I had, and which was my security to ensure ex paid his settlement to me (had been ordered to be sold if he didn’t)

Obviously now it’s paid and I need to finish it.
I found an example online, but it is incredibly wordy and I don’t know if I really need to put it all.

Any help much appreciated!

You only need a statement if it is more than 12 months since the decree nisi.

If a statement is required, you need to explain why you have delayed, confirm whether you have lived with your ex since the decree nisi and, if so, give dates, and (assuming you are female) whether you have given birth since the decree nisi and, if so, whether your ex is or may be the father.

Thankyou, it’s been well over the 12 months unfortunately.

Do I need to do it in the Court style format or can it just be a simple typed out word document with our names and case number?

So I could just say that I delayed to prevent my Home rights notice being automatically removed due to awaiting completion of the payments, we’ve not lived together since the Nisi and I haven’t had any more children?

Is that enough or does it need to be more involved?

It doesn't need to be in any particular format. A covering letter would do. You are correct that you should include names and case number. I would explain the reason for delay in a bit more detail as you did in your OP.

Another quick question!!

How do I apply for the Absolute after 12 months? I did it online originally, but I am assuming I can’t continue it online due to needing a statement? I’m not quite sure if there is a specific form I need and the internet is not very clear!

So this happened to me. We were well over 12 months due to getting consent order sorted. I had done everything online and applied for the absolute online. They then sent me an email stating as it had been over 12 months they needed a statement and basically told me exactly what to say. So I did that and no problem

Excellent, Thankyou, I did look on my application online and it said I could apply, but I had no idea how/where to do the statement!!

Will do it online then and wait for them to get back in touch with me.

Much appreciated x

Just double checked my emails and after I’d applied online I received this

“Please login to online portal to view the judges order relating to your application for decree absolute Out of time

Sign in to your account:”

and followed their instructions. It didn’t hold things up too long. Good luck
