Hi all,
My twins have been bullied by a girl for 6 months. She has tried and succeeded to some degree to turn everyone against them. They are 15 (all girls). The final straw is that she (bully girl) has an image/video of my daughters bottom (my daughter didn't realize her skirt was up at the back). She is wearing a thong, so she is completely exposed. The bully has sent this round to hundreds of people via snapchat and instagram. I'm wondering if I can do anything about this, is it illegal? Many thanks,

It could be argued that it falls under
www.legislation.gov.uk/ukpga/1978/37

it is an offence to make, distribute, possess or show any indecent images of anyone aged under 18.

An email safeguarding lead would be a good idea. This is cyber bullying and verging on revenge porn type behavior.

I've just checked the legislation in case there was a requirement to prove it was for sexual gratification but it also includes to cause alarm or distress so I would report it.

thanks all. it was seen by school friends, she (bully) showed the football team they both play for, i've had calls from people at other schools saying they'e seen it. what the hell is wrong with people?!

It is not upskirting as currently defined. The offence requires using equipment beneath the clothing of another person to observe their genitals, buttocks or underwear when they would not otherwise be visible. In this case, the OP's daughter's buttocks were visible, albeit unintentionally, and the offender did not use equipment beneath her clothing.

It may fall under indecent photographs of children as GCITC suggests.

Yes definitely report this to the police and the school. Don't let either try and dismiss it as "horseplay "

That is horrendous, I would expect school safeguarding to take it extremely seriously and definitely get the police involved too.

Report to both police and safeguarding lead at school.

I'm not 100% sure, but it's potentially distributing indecent images of a child. I'd report to the school and possibly the police
