Mum of two being kicked out of rental 😩

Hello! Just wondering if vacant possession trumps a rental agreement?

You can't just be kicked out of a rental property. Have you been served a section 21?

Has the house you are living in need sold? And your landlord promised vacant possession to the buyer?

if that is the case, the landlord has to legally evict you before they can offer vacant possession to the buyer. This means the full s21 notice (assuming you are outside a fixed term) which takes two months. Then if you fail to leave the landlord can apply to the court for possession and eventually (months) bailiffs will remove you.

the fact that the landlord has promised vacant possession to a buyer cannot override any of that

Sorry everyone, trying to multitask. We have a contract with our current landlords and they need us out by the end of it, despite a verbal agreement due to them selling their house. However before agreeing to a new rental agreement with a different landlord, I want to ensure I’m not in this position again. If we have a rental agreement in place in the new house and the landlord sells, is it possible for them to give us notice before the rental agreement is up due to a buyers demand? Or does our rental agreement protect us? Is there anything I need to watch out for in a rental agreement before signing? Thanks for your help, hope this is clearer! Honestly wasn’t expecting such a huge and speedy response so thank you!

A rental agreement should protect you - they can't kick you out against the terms of the agreement just because someone wants to move in. They will need to to serve you a sec21 notice with whatever notice was agreed, usually 2 months, and you still don't have to leave at the end of that, you can wait to be evicted, which will take some time

I'm still not sure I understand what the deal is with your current LL - they can't force you out against terms of lease.
