Unauthorised photography within my home and sharing of the photographs

I found out that a contractor has taken photographs of the inside of my home that I did not authorise, one of them has got my child in the corner I’m fucking furious about. Obviously it’s gone from one employees phone to another and then it’s been forwarded onto who is thinks is me but actually I’m using an email address that isn’t the one that he would have on my contract if that makes sense so I think he’s on thin ice with that.

This can’t be legal surely ?

The money that has exchanged hands is nearly 5 grand for materials that they claim they’ve purchased so where are they ? why didn’t they leave them if they can’t do the work the paint etc they should be with the person that paid for them.

The whole thing just stinks of them not actually being available to do this job and wanting to bump me till after Christmas or maybe even longer while still holding onto my deposit.

OP, you need to sort out the issue of them not doing the work.

Arguing about a photograph of your toddler, is a distraction from the main point of you having hired them to do work and them not being in a position to be able to do it for whatever reason.

I mean this kindly, but you arguing about them over the photograph is not going to help with actually getting them to do the work.
In fact, it is probably just going to delay things further.

Unfortunately there is no law against someone taking photographs of your home if they had permission to be inside your home.

There is an expectation of privacy in your own home and to take photos without your permission is a breach of that expectation. However it's a civil matter with damages as your remedy. Which is pretty worthless unless you are exceptionally wealthy. It would be a good negotiating point though, especially as your child is in it.

And that’s my point and I have absolutely no intention of seeking compensation but I do want them to return my money and never darken my door again.

if I had CCTV inside my house and was filming them, I have to give them warning so that they can make a decision as to whether they want to be filmed or not.

Ok, this I don't believe. No tradesman turns up at 8.50am, to see the client about to leave for nursery at 9am with her child, and states "I can't work with a child here." Because you would simply say "We're now leaving, see you in half an hour when I return from the nursery run." And the tradesman would have started work.

Did they get there at 7am, and your child was going to be around until 9am? More like that?

When I had the loft converted, I had to pay a lot upfront, for specialist supports and stuff that needed to be bespoke made. They don't bring the whole lot on day one. Especially if they think they can't do any of the work.

The whole thing just stinks of them not actually being available to do this job and wanting to bump me till after Christmas or maybe even longer while still holding onto my deposit.

Or, they couldn't work with your son in the house. Your son was in the house. So they couldn't work.

I agree with the op though knowone has a right to take photos of your child especially without permission. It should be illegal but at least from an ethical point of view it's not ok. I would be angry too of someone took a photo of my child.

so you are sitting there with your child dressed, eaten breakfast, bag packed, all ready to go to nursery. You are just waiting to let in the contractor, do the intros, and then whisk child away.

but what actually happens is that your contractor is a character from Monsters Inc. and he is like, no, not a child, snaps a photo, and runs away before the CDA can arrive to shave, scrub, and slap a cone around his neck.

Or, they couldn't work with your son in the house. Your son was in the house. So they couldn't work.

  1. They were being lead from the front of the house to the back of the house where they were expected to work. I turned around and they were no longer behind me they were busy snapping my house which I did not realise until I was sent through the photographs.
    it wouldn’t of mattered whether the child was there for 10 minutes or the whole of the day they were perfectly able to work at the back of the house whilst the child was at the front no matter what the time frame.

I can accept that they wouldn’t have all of the materials with them on day one however they didn’t have any materials with them because they haven’t left them at my house, as the legal owner of these materials they should be in my possession having paid for them.

Again even if it was true that he was the problem that needed to be communicated.

I once had a lovely couple of plumbers out to power flush my radiators. Except, turns out I had "pinholes" in my radiators so they couldn't do the flush because they would rupture. Young fella said he needed to take photos for the office to show why they couldn't do the job (but still charge me for the call-out). The office emailed them back to me. There was my big ugly grey bra drying on the bedroom radiator.
