How long does probate take

No will , solicitors have been instructed. Looks like also a joint house owned as well we are led to believe possibly tenants in common. Bank account. Personal belongings.

I've just notification that probate has been granted seven weeks after doing it online. Straightforward, second one of a couple to die, house owned outright.

A bit of both if that makes sense , tricky thing the other person who owns house jointly is a boyfriend. The person who died is still married! The death was unexpected, they have children Albeit adults now. There is also bad feeling from boyfriend and dead persons family not the children or spouse.

Sounds like you have many more complicating factors (intestate, query over property ownership, bad feelings) which will take time to sort out.

The executors are not under any obligation to distribute the estate within the first 12 months from the date of death, although sometimes the estate is distributed within that time. If there are complications or disputes, it could take years.

I have a feeling this may happen, especially regarding property (don’t know about equity amount I’m assuming quite a bit or the house may be unencumbered. The boyfriend has already prior to the children instructing sols tried to get one to sign a form to empty the bank account as he wanted the money. The person had previously worked in a solicitor office and said no it’s fraud I’m not entitled to it.
Its upsetting one of the adult children and she suffers with anxiety. I think I’ll just tell them try to put it to the back of your mind it could take a year and ignore your nasty family members.

I do this for a living , dependant on assets etc the forms can be completely quire quickly . However it's taking about 6 months to get the actual probate through , even for the simplest of cases .

There's a huge backlog of cases and the it's taking us nearly an hour to get through to be told it's in the system .

I'd get advice from a estates lawyer asap .

If there is no will and she was married, would the estate not go to her husband?
