Hi 👋 I’ve been searching high and low for an answer to this but can’t find it anywhere so was wondering if anyone could help without me paying for a solicitor…
Im determined to divorce my husband… he’s been messaging prostitutes and he has anger issues. It’s his house on the mortgage and was his from the beginning but we are married for 5yrs and 2 young children.
I can’t stand being around him any more. He won’t move out as in debt and broke.
I can save , move out and hopefully apply for benefits… but here’s the question…. Am
i legally entitled to my share of the house if I leave first and soon? X

As you are married you are entitled to a share of the assets. That includes the house.

You won't get any money soon though. Your husband will either have to buy you out, assuming that the mortgage company will let him add extra to the mortgage (which they may not if he is in debt and broke) or sell the house, which will take time.

You can't possibly know this on the strength of the information avaialble. For instance, no one can say whether OP might get the house transferred to them.

OP - take advice from a solicitor who can get all the relevant information from you.

I agree that the OP needs to speak to a Solicitor however even if the house was transferred to her (unlikely, but possible I suppose), it still won't be a quick process and won't give her any money soon.

I wasn't saying that she won't get anything, I was saying that it won't be soon, which is what she asked.
