Can you remove an administrator of a will?

My mum died 2 years ago. Myself and my sister are the joint administrators of the estate. My sister has been very difficult throughout the process, for example refusing to pay the full amount of IHT even though there are enough funds to do so. Her refusal means we now have a huge interest payment.

The solicitors we are using are very good but my sister has complained about them constantly and in asking the same questions over and over again, the legal bills are far higher than they should be.

There are 2 flats to sell. One flat finally sold in February this year after my sister causing delays and stress to the buyer.

The other flat is not yet sold despite buyers being ready to exchange for SIX months. My sister has signed the papers but has refused to release them until other estate matters are resolved.

She has now issued a formal complaint about the solicitors and this is now causing yet more delays.

She is not fulfilling her duty as an administrator, can I apply to have her removed?

You can apply to the courts to have her removed as an executor. An application will only succeed if you can convince the court that her actions are stopping the estate being administered properly or are adversely affecting the welfare of the beneficiaries. You should take proper legal advice before going down this route.
