What are my legal rights in regards to cancelling a service

Hi there,

Please can someone advise me what my legal rights are in regards to cancelling a surveyor. I haven't actually appointed him, signed any letters. All k asked him to do was send out a party wall notice to my neighbour. I'm getting an extension done.

I've since found out the surveyor has a massively bad reputation, court cases against him etc. I really don't want to use him for anymore of the party wall matters.

My elderly neighbour received the notices on Friday and appointed him as our joint surveyor. She wants a schedule of condition which is fair enough. I've explained the situation to her, and she is fine to also cancel the appointment.

The appointment only happened on Friday so we are well within the 7 cooling period (this is what he has in his contract) but I think it's 14 days? Am I correct in this all? I've paid for the notices, so I owe him nothing.

What is the formal way to cancel his services for both me and my neighbour please?

I found this in the terms and conditions, does this mean I can cancel the contract:

Any concerns of questions in respect of any of these terms should be brought to our attention I writing within 7 days from the date of this client care letter.

If further time is required to consider and/or take time to obtain the appropriate legal advice, the appointing owner should advise XX at their earliest opportunity, and we will be entitled to suspend all services forthwith.

The 14-day minimum cooling off period only applies when you buy a service online, by mail order or over the phone.

Just tell him that you've decided not to use his services any further. You don't need any particular form of words, nor are there any legal requirements you have to follow.

Read the first sentence. It says, "If you want to cancel a service you've arranged online, over the phone or by mail order, you get a 14-day cooling off period". That is exactly what I said. If you arrange the service in some other way, there is no legal requirement for any cooling off period.

It is true that you also get the cooling off period if they approach you away from their business premises, but I doubt that is what happened. I've not seen surveyors out on the streets canvassing for business!

If you went to the surveyor's office to book his services, there is no requirement for any cooling off period.
