Hello

does anyone know that if a child’s medical done by SS has deemed injuries to be consistent with explanation of injury by the child will family court look at this when father going for contact?

note the police did no further action due to lack of evidence?

Take it back to police and get your solicitor to present the case fully to the judge also ask ss - is it clear that injury was done by father? According to the child? How old is the child?
I would complain to the police if they took no further action. And keep going ….

Firstly the medical is only arranged by SS, it is done by a paediatrician. If the court does look at it they will take it that the explanation was consistent as per the report. You give no details as to the age of the child, the injury or cause, but if it happened due to lack of care the court may look at that, eg young child, lack of supervision, or they may dismiss it if unpreventable. They may also look at whether medical attention was sought as appropriate.

And if being blown out of proportion by an abusive ex, please don't panic yourself. The courts will look at it factually and what the investigation showed x

police are adamant no further action due to his current gf backing him ( who he has also abused incidently )

So child reported being dragged by their top, causing strangulation and bruising, and this necessitated a child protection paediatric medical which confirmed the injuries noted were consistent with this account, what happened next? Did the child undertake an Achieving Best Evidence interview with police and social worker? What will the social services records say - what did they advise or do?

the judge will consider the paediatric exam in any court case, but I imagine there ought to be social care and police records as well.

The judge will certainly read the paediatric exam and the local authority / police material

not being charged by police / cps does not mean the judge will not uphold / find abuse and make decisions with that in mind

Standard of proof from criminal law is "beyond reasonable doubt". The standard of proof for family law is the "balance of probabilities ", ie more likely than not. This means the standard of proof for a criminal conviction is much higher. A family judge can still make a finding of fact that something happened, even if there is no criminal conviction or even a charge.
