I need some advice for a family member please.

Very long story so I'll try and just give the relevant details. Big family scandal happened about 2 years ago. My nan (who had just had a stoke) was brainwashed by a family member in to changing her will and kicking my grandad out of the house (who had dementia). Spoke to police, solicitors etc but nothing could be done at the time.

A solicitor deemed my grandad of sound kind enough at that time to change his will so that my DM could be entitled to his half of the house if he passed. This was because the other sibling had done the brainwashing and was basically going to leave my grandad and the other children with nothing. Had to have lots of drs appt etc to prove his capacity so it was all above board.

Since then the sibling that did this to my Nan has moved in to her house and sold her own. She's also moved her grown up children in. In terms of the tenants in common, if my grandad was to pass first will they be able to make a claim for the house based on the fact they've moved in? Despite not having official permission to move in? My grandparents now neither have the capacity to agree to this and never would have done as their relationship with this child was strained to begin with?

If his share is left to your dm she would inherit it. Who does your nan leave her share to?

@LIZS thanks for your reply. Her half is left to the sibling that has moved in. Somebody told us that if she has moved in she can claim the whole house because it will be her only residence so that is what we were worried about. My Dm is entitled to my grandads half of the house in the will though.
