Hello

I have received a c100 form requesting a CAO as my ex partner 'is denied access and visitation', he sees baby for 2 hours twice a week so a bit confused by this claim.

However, I'd like to apply for a residence or lives with order. Can someone explain how I do this please? I have the C7 form to show acknowledgement but do I need to complete and pay for a c100 application or can I request an order with his? The C7 asks if i intend to make an order but no space to write about it just a yes or no tick box.

Can i say that the c100 application is factually incorrect?

I really cant afford a lawyer and hoping to do most of it myself but any help gratefully received.

Maybe he thinks that’s an inappropriately low level of access. I went to court before daughter was 1 and now have shared care of our toddler (50/50) before third birthday. . Not many dads go to court for babies so he must be serious.

Gives me the warm fuzzies when dads go to courts for babies. Dads can be fantastic with babies. No reason they should be any less restricted than a mum unless there’s breast feeding.

Imagine getting the warm fuzzies over people going to court, and all the conflict and stress that can cause.

OP, how is your communication normally? Usually the expectation is that you go to mediation if you can’t agree on what time he spends with child. It’s much better if you can come to a reasonable agreement rather than going through the courts, having it hanging over your head for months then potentially having a stranger make the decisions for your child instead of both of you.

if you are intent on going to court, I have seen the judiciary accept verbal applications for live with orders as part of existing proceedings but you can also send in your own C100.

Communication is fine, see each other at pick up and drop off and has yet to mention anything to me.

2 x2 hrs is what he asked for as he lives 4 hours away. All agreed in the parenting plan, yet the application statement makes no ref to this and is full of untruths.

The form states he has done mediation, but everytime I have offered he has refused and I've never been asked.
