CCJ from minor car accident

In 2018 I had a minor car accident, in a retail car park

Details were swapped, I didn't hear anything, told my insurance company (fleet company policy)

I got my car repaired without going through insurance - cheaper than paying excess

Today I've had a letter to say that the other person is issuing a claim for £6K as the insurance haven't paid

Since the day of the accident this is the first I have heard that a claim was filed

What on earth do I do?

I know that CCJs are serious, I haven't moved address, company haven't moved insurance companies so it can't be a case that I haven't got paperwork etc!

Help- anyone!

Sounds like there has been a claim running in the background that has now settled but your insurers haven’t issued the payment within the stipulated period. It’s a very common tactic now to threaten enforcement proceedings so the solicitors can make more money from the claim.

I suggest you speak to the claimant to find out what is going on and then the insurance company. Depending on what is going on then go from there.

If you getter a letter before claim, then this is part of the court protocol and you MUST respond or you will end up with a CCJ by default. However, as said, the insurer should sort this out

Just contact the insurance company and send the paperwork to them recorded delivery. It needs to be responded to but they should do it.

It's very common, don't worry.

To add, they have to issue proceedings against you and not the insurance co because you were the driver.

Phew, this is in a way reassuring that it's a common tactic- I'll get onto the insurers first thing tomorrow- thanks for the responses

I thought the same re the bill- seriously it's ridiculous!

The bill might not be as ridiculous as you think. Possible new parts, repairs, prep and paint. Plus the cost of a hire car when the other party's is being prepared.
