DBS check

Hello! there after speaking with a few solicitors, I'm unsure exactly what to think, I'm most probably worrying for no reason as it's never been a problem before as I've had 2 previous DBS checks in the past but that was for amazon and a contracting job, however, I've just come to learn there are different levels, basic standard & enhanced.

my question really is can anyone shed some light or give me a clearer insight I'm 28 years of age now, and I'm starting a new job, I have to finalise a few things and one of those things is to partake in a DBS check its a really good job I've worked incredibly hard to ace the interviews, it's within maintenance, but I was involved in affray when I was 17 years of age, I wasn't convicted, or sent to prison but I had to complete 9 months of community service since then I have never been involved in any crime whatsoever, that's almost 11 years ago surely this shouldn't affect me? I'm confused really because my solicitor at the time said I wouldn't have a criminal record.

If you didn't get convicted why did you serve a sentence of community service ???

My partner had criminal damage on his from over 30 years before ( fell through the roof of a bus stop as a teenager).
Discussed it at the interview and it wasn’t a problem. Just don’t try to hide it, be honest and I imagine you’ll be ok

If you weren't charged it won't show, but why would you serve community service if not convicted? Even if it did show the employer can choose to ignore.

Am pretty sure that your conviction will be 'spent' and therefore won't appear on a basic check.

And the more revealing standard and enhanced checks can only be made for specified jobs. There is information about which jobs here: unlock.org.uk/advice/a-to-z-eligibility/

Affray is violence and you must have a conviction if you had community service. Your record is probably on PNC, with your fingerprints and DNA - so it will probably appear on your DBS check.

I am puzzled as to why you had to do community service if you weren't convicted. That doesn't seem to make sense.

If there was no conviction, this offence will not appear on DBS checks. However, if you were convicted it will appear on standard and enhanced checks forever - affray is one of the offences that is never removed from DBS checks.

If this is on your DBS check, your employer has to consider whether it is relevant. They may decide that an offence 11 years ago is not relevant if your record since has been clear.
