I want to ask all parents with adult disabled children.
I have a 25 years old daughter with autism who lives in a care home.
She is severely autistic and gets high rates benefit, I do not do her shopping and leave her bank card with care home staff however I am her appointee but some times have problems with her bank (Lloyd's bank) when I talk on her behalf they ask for dupityship documents from court.
I recently asked social services to fill in the cop 3 forms so I can apply to be her deputy but after filling in all forms I see that there is a court fee of £371 and further same fee every year.
I do not understand why i should spend this money and specially every year.
I read that you can apply for rebate but my daughters benefits are more than the limit they say for refund.
What do other parents do,please tell me a good solution.
I also have 2 more children with autism age under 14 years age and will face this problem in future

You seem to have misunderstood the annual supervision fee. The annual fee for general supervision is £320. However, after the first year, provided you are managing less than £21,000, you are likely to move to minimal supervision. This is only £35. You can take these fees from your daughter's benefits.

The court fee for deputyship is £371, please see image.
It's to manage her finances.
I filled in cop 1 form and social worker d8d cop 3, there is cop 4 aswell which I filled in.

I know what the court fee is. However, you don't pay that annually. As the image says, there is an annual supervision fee. I set out the rates for that in my previous post.

You might be able to get the supervision fee dropped. I am my son's deputy and we don't pay the fee. For finance you can pay the application fee from your dd's funds not yours. I agree with you that it is unfair to have to pay and the forms are horrendously archaic and over complicated. It is also like having another job.

For finance 8s COP1 for, is there a different form for supervision?
I sent them an email w8th questions and never got a reply, do I need I solicitor to help me?
I have filled in COP1,COP4 and COP3 is d9ne by SS.
Should I just send these forms with a postal order fee of £371?
Do I need to send anything else with these forms?

Thanks

You say your daughter's benefits are over the limit for a refund. Are you including PIP in that? PIP would normally be disregarded for anything means-tested.

If she is in a care home surely all of her income is going towards her care home fees apart from her weekly personal allowance?

We wouldn't usually advise families in that position to go to the effort of getting financial deputyship as its only really any use if you are dealing with high sums of money or property e.g from an inheritance/ trusts

If its just benefits then it can usually be covered by appointeeship.

If she is in supported living rather than a care home then that is a slightly different matter as its really helpful when signing tenancy agreements/ sorting bills out etc?

MemSahb · 23/05/2022 11:09

She is in supported living.
I have appointeship from dwp.
She gets 2 benefits which are EESA and PIPS and it's total £15,197 annual.
She has no other money or property.
I manage her online account to pay for her supported living utility bills and some council charges but I don't know if I am supposed to do this?
When we opened her account with Lloyd bank, they accepted appointee letter and issued a card in my name too but now sometimes when her card payments get blocked and I call on her behalf, the bank asks for dupityship from court.
The government site says you don't need to a deputyship for benefits but it's not clear once this money is in a bank, I still have authority to help her?
How to satisfy the bank?
I don't want go through courts orders unless it's required by law
