Original probate

Hi

After a very long journey we were due to close yesterday but our solicitor has advised we cannot complete our purchase as they have only given us a certified copy of the probate deed and we need the original. Will a certified copy not do with the original to follow?? We are under pressure as moving out of our rental with our four children and who knows how long a new one will take to issue. Greatly appreciate any advice on this :)

No a solicitor certified photocopy is not enough. This should have been flagged up much earlier in the process tbh. It should be fine, the other side can just give an undertaking to provide a sealed copy ASAP.

Thank you so much for your reply. Should an undertaking from the other solicitor be enough or do we need to wait for them to get the original probate issued ? Really appreciate your advice.

An undertaking should be enough, to avoid messing up completion. If they have a certified copy it should just be a Case of ordering a sealed copy from the registry as a formality. Costs £1.50! Seller probably has a copy anyway, your solicitor just needs to ask the question.
