Does anyone know anything about agricultural ties on houses?

House has an agricultural tie on it, meaning it can only be sold to someone "in" agriculture.

Solicitor has advised that house has to be "actively marketed" for 12 months before we can apply for the ag tie to be lifted.

Does anyone have any knowledge in this, what do you have to do to prove you are "in" agriculture, can the house be marketed but any potential offers refused for 12 months?

To be "in" agriculture you have to be wholly or mainly employed in the agricultural sector.

If you refuse any offers, you are not actively marketing the property. You will need to show that there was little or no interest from prospective buyers.

Are you living in this house and selling it? If you don’t work in agriculture snd have lived in it for 10 years you can apply for a Certificate of Lawfulness.

The ties are usually there for a reason.

You need to check the wording, different areas sometimes have different stipulations of what constitutes “in” agriculture. Are you struggling to sell it or are you trying to remove the tie so you can sell it for more money? I hate this, it’s just more removing cheaper homes from workers who are desperately needed for farms etc but who often can’t afford to live in the areas in which they work. If it’s actually yours, and you’ve presumably benefitted from the ag tie, why do you need to remove it? If you’ve inherited it and need to sell it, why do you need to remove it just so you can make more money? Is an inherited property not enough money for you as it is?
