Party wall

I have a conversatory in my back garden it’s about 50cm away from the fence

i live in a semi detached and my neighbours want to build an extension on their house up to the border (removing the fence that’s their responsibility)

do we need a party wall agreement in place? My neighbour says we don’t and it’s just a waste of her money

will my conservatory suffer from damp if they build so close?

Yes you do need a party wall agreement. Look at the government web site and explanation booklet which clearly says they will need it because it’s within 3 m of your property and the foundations are on the boundary. Do not allow anyone into your garden to do anything. They will also have foundations near your conservatory and where your house joins theirs on the back wall. (I assume).

Write to them saying they cannot do anything until you have both agreed the party wall agreement and quote the law. There might be a suitable template in the booklet.

When they give you the agreement, object to it. You then appoint your own party wall surveyor to act for you at their expense. Obviously they will be able to build but you need to look after your interests.
