Anyone know the legalities of what’s allowed?
pub next to us are building a tall structure and decking in a previously (at least 10 yrs) part of their land right next to our hedge.

dh overheard the builder telling someone it’s an outdoor kitchen.

I texted owner today. She says it’s just going to be a shelter without walls or heating.

last year they put another permanent structure right up against the front section of our garden which is full as I type of a rowdy gang of about 15 people.

i asked the owner to send the builder off site as he was working on a Sunday and she’s done so (and banned me 🙄🤪)

obviously I’ll call planning dept and specialist solicitors on Tuesday but wondered if anyone happens to know the law on this?

Presumably the pub was there, but not the structure currently being built. Hence the OP's question.

If it has no more than 2 walls, the decking is no more than 30cm above the ground and any cooking facility is not permanent eg it's a gas bbq powered by propane rather than plumbed in gas, I don't think you need planning permission because it's a permitted garden structure, sheds only need planning of over a certain size too. Working hours are in your favour, it varies by local authority but typically it's 8am-6pm Mon-Fri and 9am to 2pm Saturdays for commercial building work (including contractors on private dwellings but not DIY) unless an emergency - I've had worked stopped myself. There is rules about being close to the boundary with foundations but for this kind of structure I'm not sure that comes into play. I know a noisy pub garden is not the nicest neighbour but I'm guessing the pub was there when you bought the house?

Thanks @gogohm that’s helpful.
A complicating factor is that I believe that the rules for licensed premises may be stricter BUT this section hasn’t been used as part of the pub garden for 18 years so I may have more of an argument on a change of use basis.
