Overpayment by ex employer

Hi,

Hope this is correct place to ask such matters.

Left an Employer end of December totally with their knowledge, recently received P45 with correct leaving date, but they've paid me unwarranted for whole month of January when they really shouldn't have.

They have managed to record the payment with HMRC too as it shows on my personal tax account.

No question of not giving it back to the ex. employer but do they have to correct tax and national insurance first?

Will I be getting someone into trouble at ex employer : (
Will my new employer be able to know this has happened to?

Hope that makes sense, I've never been in this situation before so would appreciate and be thankful for any guidance.

Your employer may not realize they've overpaid you. Payroll errors are remarkably common.

You should contact your ex employer, notify them of the error and ask for the procedure to return the funds. They should calculate the overpayment and confirm to you the sum to repay & how / where to send the funds. On receipt of the funds they will then do a payroll adjustment to correct your payroll record (including taxes, NI etc), which in turn feeds to HRMC to adjust your tax record. It can be a lengthy and painful process..

Recommend you do this asap to ensure it's all corrected with the applicable tax year else it gets messy.

Meant to say you'd receive a revised P45, which you'd give to your new employer.

No one will get in trouble.. it happens.
