An elderly relative is undergoing dementia tests one of my family is trying to persuade him to sign their estate over to them . The known member is aggressive and police have already been involved !! I need to protect this person but they will know it’s me and I am scared of the consequences. What should I do? I need to protect their home !

If your elderly relative is undergoing dementia tests you must already have doubts about their capacity. Someone who lacks capacity is not able, in law, to enter into financial transactions or contracts so legally, would not be able to sign his house over. It wouldn't be a legally binding transaction.

Best bet is to report his attempts to the police or have a word with the solicitors involved but most Probate solicitors are trained to look out for events such as these anyway

As pp, your relative is not in a position to sign legal documents. They won't allow it.

It must be very worrying for you. If you haven't already, do consider asking Age UK (formerly Help the Aged/Age Concern) for some information and support. They're very good and you can seek advice in confidence. Their website is at www.ageuk.org.uk/information-advice/.

Executor is the solicitor thank fully but worry a new solicitor will be used !
