Power of attorney

Before my dad was really ill I became his power of attorney and it really helped sort everything out on his behalf and make decisions when he no longer could.

Now my mom is very ill and definitely doesn't have capacity to make decisions etc but did not arrange a LPA like my dad did, Is there something similar I can apply for now to help sort her finances out and in particular at the moment make health decisions?

In this situation you may want to consider applying to the Court of Protection for a deputy to be appointed.

Speak to a solicitor. Whilst she may not be able to make some of her own decisions she may still have capacity to make an EPA.

www.gov.uk/become-deputy/apply-deputy I’ve heard it can take time and be a bit of a palaver.

If you are her next of kin and she clearly lacks capacity then that will help with some health decisions.

Deputyship. But be warned, it’s expensive and takes ages. It took nearly a year to get the order heard at court and then another six months to get the actual paperwork from the court of protection. My mum died before I received any paperwork so I was never able to use it.

I always tell everyone I know to make sure they have power of attorney in place.
No help to you though. Sorry.
And I also think most deputyships are financial only, not health?
To put it bluntly, how Ill is your mother? It may not be worth applying.
