Probate and Inheritance tax

My mil has recently died and her only son (dh) is due to inherit her estate.

We are trying to figure out if we need to go through Probate and if any inheritance tax is due.

We lived together and both her and dh owned the property valued at 900K+, she owned 2/3rds. They are joint tenants. I believe her portion of the property goes to dh on death. Does the house count in her estate?

She has roughly 50K in bank account and 8K in an ISA.

Anyone know if we need probate or need to pay inheritance tax?

Is your FIL also dead? The value allowed is doubled. The probate office was very helpful after my DM passed away and the forms online are relatively simple if there are no other family involved. I did it all with no solicitor necessary.

As they are joint tenants, the house does not form part of her estate.

Whether you will need probate depends on the bank and the ISA provider. They may want your DH to apply for probate to give him authority to deal with her estate. If the £50k is in one bank account, I suspect the bank will want that.

If there is nothing else other than the bank account and ISA, there will be no IHT to pay.
