It's a Will one...

Luckily though just me asking for advice.

I have an appointment this week to make a will. My situation is as follows:

Own a larger portion of our family than home DH as it was my house before we got together.

2 children from first marriage

1 child with DH

Life insurance in place which will cover the mortgage and around £50k in cash afterwards.

I guess in my mind I was everything to go to the kids eventually in an equal split. It's the classic case of safeguarding it for them if DH ever remarried.

Any simple solutions?

I know I can ask solicitor at appointment but trying to get ahead.

It’s good you are seeing a solicitor who will advise you.

One option is, own property as tenants in common. Deed of trust to show % if not 50:50. Will leaves your share to DC with lifetime interest to DH.

Your solicitor is likely to come up with the same solution as Alpinechalet. If you currently own the property as joint tenant, sever the joint tenancy. However, since you say you own a larger portion of the family home than your husband, I hope that means you already own the house as tenants in common and have a Deed of Trust in place. Leave your husband a lifetime interest in your share of the property with it going to your children on his death.

Thank you both, yes we already have the tenants in common and deed of trusts in place, unfortunately a previous divorce left me knowledgeable enough to cover myself in that regard.

Life interest to DH. Looks after him but safeguards inheritance for your kids. Maybe include a power to appoint capital.

You can do a lifetime interest to your DH
You may be able to put in a clause that if he remarried or cohabitates then the house has to be sold and your kids given there half
Make sure your will is somewhere safe and let a few people in your family know where its kept so it will be easy to be found
National will safe store wills for a nominal
amount
