Probate

My father died five weeks ago and my brother and I are executors (please, no sympathy etc as it was a relief because he was so abusive to all his kids his whole life).

All of us are just wanting to put an end to this but we need to apply for probate.

Is this something my brother and I can do without a solicitor. His estate is going to be around £25k.

I have a lot else going on and struggling with depression stemming from sight loss and losing my career so I could do with something to make me feel useful again and use my good brain.

Thank you in advance

Yes, it’s not too difficult. Quite a lot of admin but you just need to trudge through it.

With assets that "low", do you actually need probate?

Many banks etc will pay out a fair amount without probate.

I administered a similar sized estate for my Gran.

The only reason I needed to get probate was that certain companies with whom she had invested money required it, as I recall. Not all did, and it wasn’t dependant on the amount invested.

Check first before applying, but if you do it’s easy. You’ll need someone to sign the paperwork (I used a solicitor) but paid a minimal amount for this. I don’t get the solicitor to apply for probate.

didn’t

When my mam died, I didn't need probate and she had no will. I am an only child. She had no other relatives and my died was dead by then. She had a bank account that was a joint account with me (£13,000) and the bank accepted her death certificate and simply removed her from the account.
She had a building society account with about £11,000 in and they transferred it to me.
She had two other building society accounts with £7000 each and they did the same.
There were 4 insurance policies that totalled about £8000 which they paid to me.
There were some shares that were transferred to my name.

None of them asked for more than a letter and the death certificate.

There used to be a Which guide called "What to do when someone dies" that took you through the whole process. Don't know if it's still available.
