Getting passport for children

Hello,

Back story, father of my children is on the eldest child birth certificate but not the youngest.

He was extremely abusive. I have a prohibited steps order against him and a child arrangements order stating the children reside with me. His only contact is 6 letters a year. (1 letter per child 3 times a year). The child arrangements order states that I can take the children out of the country for 28 days without his permission.

My understanding is that I don’t need his permission for the youngest to get a passport as he is not on the birth certificate, however, I do for the eldest as he is on her birth certificate.

Does anyone know about this? I’m aware I may have to get courts permission to apply for one for her.

It’s my eldest that needs one more as she is starting high school next year and they do international trips every year.

I have a restraining order against him which runs out in June next year.

I am awaiting a call back from my solicitor on Monday as he’s out of the office.

Could anyone shed any light in the meantime?

I didn't need permission to get my eldest's passport. I wrote a letter explaining the situation and they did come back and ask for a copy of mine and my mum's birth certificate to prove she was entitled to a British passport. Basically I'd submit the form with a letter about your circumstances abd they'll let you know what to do. We didn't have a a court order so you might not need to jump through the hoops I did

No you don’t need his permission I have both my kids Passports despite ex being on the bc I just left the dad bit blank on the form (didn’t offer any explanation) and got both fine, it’s travelling you need permission.

Oh sorry I missed that, no you wouldn’t need it.

The answer is in the child arrangements order. You only need his consent if you intend to take your children out of the country for more than 28 days.
