Price has risen after paying deposit. Can i get deposit back?

I agreed for new window installation last year in June and paid the deposit of 2000 pounds. For 4 months I heard nothing and then i got told by the company that the price will rise by £3000.I was never told this before I signed the order, otherwise I would never have gone through with it. I cannot afford that and i said i want to cancel the order and get my deposit back. They said that I cannot get it back as the cooling off period is over and in addition they want more money as part of the contract. What can i do?

Check the contract you signed

GreyhoundG1rl · 06/11/2021 16:05

Surely your contract specifies the price?

IveGotASongThatllGetOnYNerves · 06/11/2021 16:07

The contract states they can charge you whatever the hell they like?
Surely that is illegal?
I'd take legal advice on this and see if small claims court would be the way to go.

Eltonsglasses · 06/11/2021 16:08

That's almost 18 months ago - what has been the reason for the delay in installation?

Longdistance · 06/11/2021 16:12

They’ve say on your money earning interest on it. I’d check contract and try and get money back. That’s an unacceptable amount of time to wait.

Worldwide21 · 06/11/2021 16:26

Sorry i meant June 2021. Yes i did check the contract and it states that I have the right to cancel the contract if the price changes but for some reason they are basically ignoring that.

Tell them to give you your money back or you will take them to small claims court.
Send them a copy of that bit of the contract

The Consumer rights Act 2015 is your friend here. There's various grounds, but sounds like you could use the failure to provide a service within a reasonable framework.
If neccessary, use a solicitor to write a 'letter before action' to them.
I've just done the the same with an 'Intensive' driving course and they agreed to reurn the money to us within days, having previously used all sorts of unreasonable 'get out clauses' in their contract.

TrollsAreSaddos · 06/11/2021 22:11

How did you pay your deposit?

ImUninsultable · 06/11/2021 22:17

A quote is legally binding. They have to do it at the price they quoted or refund your deposit.

Take them to small claims court. You will win.

Worldwide21 · 07/11/2021 08:46

Thanks for your help.I have written a strong email to them stating why I have cancelled in accordance with the terms and condition set out in the initial contract. Otherwise I will have to take them to small claims court.
I paid by credit card but too much time elapsed as they only told me about the change in price a few weeks ago so the credit card comapny will not return the deposit .
