Using video footage

Can anyone shed some light on if you can use video footage as evidence against someone?

Me and my DP went shopping yesterday and did not realise his ex W was lurking around. She had made all sorts of accusations over the years which we have just kind of laughed off but nothing much for a while until yesterday.

I had found a right bargain at one of the shops we was in so we got a whole tray of the product in question, and I took a selfie in the car park by my car of myself with the product and sent it to my friend who is a huge fan of the stuff.

Apparently, and unknown to us, the ex W was around in the retail car park and she has reported my DP to the police for taking pictures of her car on the grounds of harassment and stalking 🤦🏻‍♀️🙄. As I did we had no idea what she was on about until I remembered today the picture I took and sent to the friend. Her car is not visible in the image or anything.

However, she said that she has 'caught us on video' doing this. Can you use video footage of someone as evidence or could the fact she was then filming us backfire on her? Not sure whether it was from her phone or her car camera.

By the way, we reported her about a few year back on stalking grounds (but serious stuff, not just taking photos of 10p peanut butter) and I did mention in the report I was worried that she would try and spin the stalking around to make us look like it was us, so not worried. We are expecting yet another letter off her solicitor over nothing.

Yes, video evidence can be used in court. However, that doesn't necessarily mean the judge would allow this video footage to be used as evidence.

Do you think we could use the fact she was filming us in the first place as a good defence?

I know it all sounds very bizarre but we have had to deal with this bizarre behaviour for years. She's tried to get the police involved many many times over things he has not done.

You should have reported her for harassment at the beginning really and kept a diary of any further incidents so they can see her pattern of behaviour.

You could still do one now with rough dates

The judge would listen to both sides
You were being filmed and there is no evidence to support her claim so that is probably enough to show she’s harassing you.

Photography and video in public is not in any way a crime, let her report away.
