Anyone know anything about getting money you are owed from a will?
Basically my grandmother has left me a sum of 10 thousand pound in her will but.my father who is dealing with it is saying there isnt enough money to pay it out? Im not 100% sure if this is true and believe he may be holding back money for himself as he doesnt work and may want to use it to live off. How would I find out if there is enough money and what future steps do I need to take? Thanks

Was a solicitor holding the Will?
If you’re a name le beneficiary it’ll depend on the wording. If she out something like After all estate matters settled X Y and Z will get a share of what left … it could be you’ll get £5k instead.
Did she tell you she left you £10k?

Is your father the residuary beneficiary? If the will says that you get 10k and he is tge residuary beneficiary and there is 11k in the estate he gets 1k. If there is 5k in the estate you get 5k he gets nothing. He is trying it on. You need to inform him you will be applying to a court to have him removed as executor. If he gives you less than 10k and there is more than 10k in the estate he is stealing from you.

There should be a Grant of Probate document in which all the estate assets and liabilities are valued and added up. You can look them up, see here:

...including a copy of the will. Your father shouldn't have been able to transfer any assets into his own name without having the G of P.

The nan sold the house to the father for a low price of 40 grand 3 hrs ago..he was her carer claiming carers allowance until she passed away..the wording was 'i leave the sum of £10,000 to my grandaughter and my name'
He is saying theres only enough money for covering the funeral cost but i haven't seen any proof off this.

You need to ask to see the accounts - is he applying for probate ?

If the house was sold to your father for less than its true value, I would strongly recommend consulting a solicitor who specialises in contentious probate. It may be that your father exercised undue influence over the sale.

Where are you expecting the £10k to come from. Did she have money in a bank account? Investments?

Was her bank account held jointly with your DF? If so all money in it passes to him, bypassing the will.

Whats did she do with the proceeds from selling the house?

@filka - I thought the grant of probate just quoted a ball park figure eg "estate does not exceed the value of £325,000" ?

Do some show a break down and total of assets ?

Search for a probate record by post
Download and fill in form PA1S to search for a probate record by post. Send it to the address on the form. You should get a response within 4 weeks.

It costs £1.50 for a search by post. This includes a copy of the probate record and will (if there is one).

Sorry ,wasn't having a go .Just thought I'd missed something .

I've seen a couple of copies of a grant of probate and apart from indicating that the total assets didn't exceed a certain amount ,have had no other financial detail .
