Or similar. I'm going round and round as I don't know what I need.

The issue is a shared courtyard to 8 houses. Some houses have one allocated parking space, but as time has moved on and houses have been sold, owners now tandem park two cars, insisting this is their right.

However part of the courtyard is a turning circle. If cars are tandem parked, access to other houses is prevented as we can't turn our cars, as is access by emergency services, delivery vehicles etc.

I know that when I bought my house, I had in a document the written details of the 'turning' circle but don't know which document this was in.

I've tried land registry paying for a search. That only gave property owner names and a plan with a red outline of each property. Not clear enough to define parking.

I rang my mortgage company, who said they would send me my deeds but in fact have sent me a reference number, but no instructions as what to do with that.

Please can anyone advise me as to what I do to find the details of the agreement around the turning circle, for my house and the other houses involved.

Have you tried looking at the planning permission for your housing development? This will be on file at your local authority (Council) and can usually be accessed online.

Particularly look at the Decision document, which will state the conditions that were attached to the granting of permission.

Also look at any comments/correspondence from the Highways Officer as there may have been issues raised around road safety that dictated the need for your "turning circle".

If the title documents refer to another deed (perhaps a past deed of transfer) it will usually say whether a copy of that deed is held on file and if it is you can get a copy.

Alternatively see what your solicitor sent you when you bought it.

The courtyard is privately owned between all of the houses. Not sure if that makes a difference.

Land registry talked of a deed of transfer.

So confusing, so difficult to get the information. Land registry still need a downloaded, printed form and a cheque....

I don't seem to have any documents from the solicitor. I thought that was because the house is mortgaged and the BS would have them, which the staff member agreed to send, but then sent a title deed number. I'm not even sure whether the BS response is correct.

Any more detailed documents from the LR - what lies "beneath" the basic information on a property e.g. a lease will require a (£7?) cheque and written request to the LR who will then forward you on the specific documents you have requested.
The LR are very helpful if you call them for advice but I'm not sure how easy it is to get through to them at the moment. You could try emailing them, giving specific details about the information you are seeking.

Definitely contact LR again as they can supply copies of relevant deeds etc. This should include the document you recall.

The Official Copy you have received should refer to the Transfer or depending on the age of the development an old Conveyance which has the restrictive covenants in it. If you are joint owners of the courtyard there may be an entirely different title number for that land which has those covenants. Either way the thing you are looking for is the Dee that created the covenants which binds you all. I would imagine that the turning circle was designated to remain unobstructed so something similar to a right to pass and re pass at all times and for all purposes by the joint owners. It really depends how the joint ownership was set up (ie a 1/8th share or specific areas with rights to the other owners reserved although the former sounds more likely).

I thought that Building societies had stopped holding deeds and sent them all to the owners, even mortgaged ones? We were sent ours, and we have a mortgage, some years ago.

When we paid off our mortgage they just sent the office copy because they (Woolwich/Halifax) had destroyed the deeds. I was bloody livid.
