Advice school fees

Currently going through court for financial part of divorce. Ex pays CMS. Children attend a religious school which ex used to pay fees for. However he stopped paying last year so we owe last years and this year. It's around £1000 for both kids per year. I've told ex I'm happy to split the cost between us but he says the CMS covers it. What's the likelihood of me getting it written in to court order to split the cost between us? Also for school trips that are costlier then normal i.e. residentials

If the decision to send them there was a joint decision or his decision before you split then there is a good liklihood I would have thought.

the court will consider the affordability of the fees for both parties, notice periods and balance that against the disruption for the children of having to move school.

It's completely off the point, but I've never heard of a few paying school charging only £500 per year.

I presume you're not in England?

Is this a mandatory fee, or one of those 'contribution to school fund' things.

I know of a few islamic schools where fees are around that figure.

I wasn't very clear. it's a mosque they attend in the evenings which we both agree to.

In which case if it is not an academic school but instead is classed as extra curricular then things might be different. Did he give notice that he would no longer be paying? If he agreed/signed them up in the first place he would be liable for any fees accrued during notice periods.

No he just stopped paying and has told the mosque it's nothing to do with him. We both want them to go but he thinks the CMS covers all costs. I would have though both parents would be liable though the mosque are chasing me for the fees.

That's not strictly true. It depends on who signed the children up in the first place, what conditions they agreed to and all sorts of other things.

However, if you continued sending the children once you knew he was no longer going to pay then you would be liable from then on in.

I used to run a children's after school activity and sometimes grandparents would enrol the child. Now I always had a signed form with terms and conditions to make it easier but in that instance it would be the grandparent who entered into the contract (contracts can be verbal)
