Is this discriminatory?

About 20% of my pay in an average year is a performance-related bonus. Performance is tracked throughout the year and then normalised across the company at the end of the year.

I went on maternity in May. Up until that point (nearly 6 months in) I had very good scores. I also worked really bloody hard! However I did not have a mid or end of year review as I wasn’t at work.

At bonus calculating time to my surprise I was given a tiny bonus, equivalent to people who had had bad scores. I expected a pro rated bonus based on my good scores, which would have been much higher.

Does anyone know if this is discriminatory of my employer? I raised it with my line manager, he followed up with leadership but I’ve heard nothing since. Tia

You are still entitled to receive a mid year review or end of year review if that is not feasible then they should have reviewed your performance up until you left for maternity leave. So for you those 6 months would count and they knew you were going on maternity leave

I found this information on acas, maternityaction and government.uk .

Please phone maternity action or acas they will advise you. It does sound like discrimination.

Thank you very much. I will try that.
