Hi I'm after some advice if possible my grandkids mum is having problems with her ex he has taken their 7 month old daughter and is not giving her back what help can she get please ( this child is not related to me) thank you

It's only "reporting" in the sense of using the report button to get Mumsnet's attention, not suggesting you've done anything wrong.

Sounds like she needs to speak to a family lawyer.

@nan26 Don't worry about the reporting, on mumsnet you can submit a report just to ask the team to move a thread to the appropriate area of the site, in this case I'm guessing a family/relationships board. You've posted in "feminism: sex and gender" so you might not get the best traffic. It's not about getting someone into trouble. As for your family situation, I don't know a lot about this, but I would look to the police as a first port of call. I hope she finds a resolution.

Ok thank you I'm new here and didn't realise I'd posted in wrong place and because the father is on birth certificate the police won't do anything unfortunately

Does he have parental responsibility? This is to do with whether his name is on the birth certificate. It would be wise for you friend to call police and social services out of hours in your area. They are unlikely to do anything unless there is immediate risk but it means there is record of the concern

Hi OP, your daughter needs to get a solicitor on board as soon as possible. If she knows where her daughter is being kept and he refuses to hand her over, her solicitor can make an emergency application to the county court.

I'm a former family lawyer but a bit rusty as I stopped working in this area in 2010. Hopefully now your question is in the right place, someone like @collaborate or @familylawsolicitor will see this and give you better, up to date advice.

You don't need a solicitor to make an urgent application, you can do it yourself (by 'you', I mean 'she').

Form C100, cost £215 - fee exemption may be available on form EX160.

Applying for a 'specific issues order' on an urgent basis, ask for a hearing within 48 hours, for the return of the baby.

A solicitor won't get a hearing any quicker than you will by filing yourself. Put the application in on Tuesday as soon as the court opens.
