Wonder if someone could help please?

My husband received a PCN charge in October 2016. If I remember correctly we did send a letter of defence at the time as the believed the charge was issued incorrectly. He had just been diagnosed with cancer and I wrote to the landowner explaining the situation. We had a favourable response and we believed it to be written off. We have had several sporadic letters since which we have ignored. This week, I have received what appears to be a County Court claim form. My husband died in March. What should I do? Respond and tell them he is deceased? Does the fine die with him or will it push it onto a claim on his estate?

They will have to amend the claim to one against the estate, although they may choose to stop proceedings if they have an ounce of integrity.

Unfortunately these parking companies are utter dregs. They won't believe you and will demand evidence etc. However, they do have form for pursuing to court as they love suing for costs that are not allowed even under the POFA.

Try writing in the first instance and suggest they apply for a copy of the death certificate if you give details.

What they rely on is the surviving relatives paying the charge as they really don't care.

There is a new code coming in soon I believe because of their appalling behaviour.

What would happen if I simply ignored the County Court claim? Would there be a hearing in his absence without anyone checking that he is still alive and at the same address? What would happen then? Surely there can't be repercussions on me as it is not my fine.

Write back and inform them he is now deceased and included a copy of the death certificate. I suspect they will leave you alone after that. If not the local press may be interested...

Do not ignore the County Court Claim, it could eventually lead to a ccj being issued without your knowledge so please go to the forum and ask for advice there.

If you are the executor of your husband's estate then yes, you could be held personally responsible if the estate is distributed without this being settled. As you have already been advised on this thread, you should inform them that your husband has died. Do not ignore the claim.
