Bit of an odd one. My DPs have today accepted an offer for their house. They've been there for almost 40 years. There are two registered titles, one for the main house and one for the adjacent field (because they acquired that bit much later).
There is a registered charge on the field property in favour of two individuals from whom DF bought a business in the early 90s. Neither he nor my DM has any recollection of the charge and are certain any monies owed in connection with the business purchase were paid decades ago.
No paperwork at all.
Both the individual lenders are deceased.
I'm concerned that this will slow down their sale (and onward purchase) considerably. They haven't appointed a solicitor yet.
I've applied for a copy of the charge from HMLR, but in terms of getting it discharged, does anyone know if they'd have to first apply to remove the lender who died first before getting the personal representatives/beneficiaries of the last-surviving lender to issue a DS1? Or would they have to get two lots of PRs/beneficiaries to do the DS1? Is there a much easier way?
No other charges from banks etc.
Thanks in advance- not my area, as you can tell! And I want them at least to make a start in contacting the right beneficiaries to prevent months of delays later on.
