Hi all

A quick question. I’m not married but cohabiting. If I leave all of my estate to my children in my will and some of them are under 18 at the time of death will my house (owned outright by me and to be left in equal shares to my kids) have to be sold immediately and split or can my children continue to live in this until they are of age? Thank you x

I am no will expert but I think you can leave the money in some sort of trust which says your children can live in the house until a certain point and then what happens to the house at that point (it's sold, money distributed equally, etc). Please check that with a solicitor though.

  1. who will look after them? You can leave it in trust for the children but the trustees get to decide what should happen to it.
  1. Will your partner get nothing? They may have a claim under the inheritance act.

This is why you need to speak to a solicitor to get a proper will done.
