Fallen over drain sticking out of pavement outside my house

We live on a new build estate and the site isn't finished yet so the roads and paths haven't been resurfaced. The roads are full of pot holes, I got a puncture after hitting one in the dark few months ago and complained to the building company who covered the cost of the repair.
Anyway there are 3 drains/sewer covers sticking up out of the pavement outside my house. We have small children and I'm worried one if going to fall over and hurt themselves. I didn't think it would be me, but I tripped over one a few days ago and went flying and have bruised my leg badly and been hobbling since.
I'm really cross! Do I have grounds to complain? Have attached a photo of the drains. Thanks.

You've moved into a building site. The top surfacing of roads and pavements is always the last thing they finish. YABU if you were not aware of this. By all means tell the site manager that you tripped over but even if he puts cones around the grids that's just another obstacle for you to trip over. You just need to be more aware of your surroundings whilst you live on a building site.

Yes complain - but is it an adopted road or an unadopted road? That will affect who you complain to.

Well of course you can complain. But others are right, this is one of the downsides of a new build estate.
They won’t resurface until all the building is complete so that they don’t end up doing it twice.
The trouble with posting this kind of thing is that it sounds like you’re out for compensation.
You don’t need to ask anyone if you can complain, just do it if you can be bothered.

I would tell them what happened. It could have been someone who was partially sighted or blind, or using a mobility aid.

I would have thought the minimum, safety wise, would be that they should be spray painted.

@Ickythefirebobby one hand on the pram, one hand holding my puppy on the lead who unsurprisingly didn't go the way I had wanted and I ended side/back stepping. It's not the strangest concepts to be honest. You know, an accident? One that wouldn't have happened had the drains been there, whether I knew they were or not.

Yes you have grounds to complain. In fact, you don't need grounds to complain, you can just go ahead and do it. I assume you are after money though and that probably depends on what loss you have suffered as a result.

@anothernewtop I wanted to ask whether others would complain or whether I'm being precious about it. It seems the majority wouldn't be bothered in the slightest which is fair enough! Our neighbours don't seem particularly fussed - one saw me falling over and came over. But then these aren't directly outside their house, and they don't have children/a pushchair/a puppy to navigate when they go for walks.
I haven't said I'm wanting compensation. Nor did I ask for any when my car was damaged on the potholes, just the cost covered it took to repair. Our street and part of the estate has been finished ages but the building company are in no rush to resurface. Clearly I should just be happy with them taking their time and never have an accident. Not that it was planned of course, with it being.. an accident.

I would complain. They should have a barricade round them rather than using cones which can be removed easily

No, I’d keep asking when they’re going to finish the surfacing and how they can make it safer until then.

@KaleSlayer I've spoken to them probably fortnightly for the last few months as the roads in particular are terrible. The drains haven't been like this as long, a month or so. They said they're busy and will get round to it within the next few months.

Just keep hassling them, inform them of your accident and make a bit of a problem for them by contacting them weekly for updates. It may help speed things up. They should at least try to do something to make it safer.

You tripped over, report to council and they'll come and fix it.
Nothing legal, it's obvious to avoid that area.
If you'd broken your leg, or ended up on sticks like my friend, that's the time to call a solicitor.
They'll think your a chancer.

Definitely complain. The site managers have a duty of care to provide a safe environment, and those clearly aren’t safe. There are sensible precautions they could take to make it safer, and they should be doing this.
