Child maintenance top up

The annual review for my CM has just taken place and it appears that my ex is now earning above the threshold for calculations, meaning if I'm to receive maintenance in line with his new salary I need to apply for a top up through the court. Does anyone have any experience of this? Would I need a solicitor to apply? CMS have been worse than useless so a court ordered amount would be awesome but I'm wondering how much hassle I'd need to go through to get to that point...I'd be really grateful to hear anyone's experiences of this.

Up to £650k a year the maintenance a court will order will be as per the CMS calculation assuming there was no limit. Over £650k a year and the percentage in excess of that can vary according to need.

Seek the advice from a solicitor initially. You may find you can get your legal fees paid if he refuses to agree a reasonable uplift.

Thanks Collaborate - my understanding though is that the maximum salary the CMS will base their calculations on is 3K per week?

That's right. Which is why you apply to the court, as you mentioned in your opening post.
