We have a neighbour from hell situation which has been a nightmare for the past four years. Long story short police have a marker on our house as my husband is considered "vulnerable" due to depression, the depression followed a wrongful arrest last year, whole other story. Although police did not uphold our official complaint, apart from the aspect that we had been treated unfairly compare to NFH. From that point police started being a lot more sympathetic in their approach to us and like I said put a marker on our house, and I had a couple of PC's admit verbally to me that terrible mistakes were made last year. Police then began a harassment investigation of our NFH, but as is often the case, not enough actual evidence to make it fly. We and they were issued with a "behaviour Guidance" document which we were very happy with, but they were not. One of the items on it is "Do Not contact directly or indirectly your neighbours other than via solicitor, mediation or mutually agreed third party" and "Do not intentionally intrude on land you know or ought to know is your neighbours without legal authority".
So fast forward to last week end's events, my husband was gardening with his headphones on, they start throwing stuff about, including our property, on the edge of our garden, the husband then comes up the bank right into my husbands face with his hands clenched behind his back (presumably to stop himself throwing a punch) shouting things like "hit me Michael, go on hit me, hit me..." and "what would the FCA think of this..", he was so in my husband's face he could feel the spit coming off him, and "We're going to report you to the FCA..." and "we're going to cost you your licence Michael". (My husband works in financial services), and "Shall we get PC G>>> back to arrest you". The wife was recording it all on her mobile. This was totally uninvited and against the rules on the behaviour guidance document. My husband got red mist and pushed them very hard off our property, really hard, no one fell over, and no one was hurt, police responded very fast, and my husband was arrested (not in handcuffs) for assault., spent hours at police HQ and released on bail. Now, luckily a neighbour over the road has come forward who witnessed the whole event from start to finish, and has told the police they were very clearly baiting my husband, we asked police to get her mobile phone footage before it's deleted to hear the audio as obviously our CCTV does not have audio. So, obviously we are worried sick that this is going to fly with the police and my husband will be done for assault. we have submitted an online report of threatening and intimidating behaviour. After which I got a call from an officer who has been dealing with us, and put together the behaviour guidance document, telling me that if this episode comes back "no further action" for my husband he will open up a harassment investigation again.
Anyone have any clues about these kind of situations?
