Sorry i don't know if this is the right place

Can someone tell me if a conviction automatically drops off a pvg after 15 years or do i need to apply for it to be removed? The offence was nearly 17 years ago. Im a different person now and really worried it will affect my job offer

Tia x

Well that all depends.

PVG as with The Disclosure and Barring Service (DBS) in England and Wales has three levels of check. Basic is just current, unspent convictions and cautions only. There are lots of calculators online to help you work out whether your conviction is spent or not - the length of time depends on your age at the time of the offence, and the sentence. Some of the most serious offences are never spent.

For standard and enhanced disclosures the DBS/DIsclosure Scotland looks at ALL convictions and cautions, whether they are spent or not. However, that's not to say that all older convictions are disclosed automatically. They go through a process called filtering - they look at the conviction and the type of job you're applying for, and decide whether it's relevant or not.

There is no 15 year rule, 10 year rule, 25 year rule. It is fair to say that length of time is a factor though; if the Police can see that you have one conviction a long time in the past and have kept out of trouble ever since, then they are perhaps more likely to filter it out. Similarly, a change in the law (in England and Wales at least) means that youth cautions are now automatically filtered in nearly all cases.

So to cut a long story short, your conviction may or may not appear depending on how relevant the police deem it to the position you are applying for.

Thanks for your help but having read up on it it does say the conviction would be removed after 15 years if i was 18 or older at the time

It really depends on the type of conviction. If it's for something like fraud or theft, yes the 15 year rule applies.

With other types of offences, especially sexual or violent offences, then there is no 15 year rule.

If you have been told that the 15 year rule applies to your particular offence, why would you think it won't? If it is treated as a protected offence then it won't be listed on any new PVG. If you're talking about removing it from a current PVG certificate, you can talk to Disclosure Scotland about getting it removed.

Its not that i dont think it wont apply, im asking if i need to apply for it to be removed or if its automatically removed after 15 years, it isnt sexual or violent
