Will you get a CCJ if you lose in small claims court but pay within 28 days?

This seems a silly question, but in the case of a small claims between two individuals, will the defendant get a CCJ even if they pay by the deadline? If so, must the CCJ be declared for credit / insurance purposes?

I understand what it is to get a ccj if you haven't paid a bill, for eg, but if this is the case I didn't realise you could get a ccj as a result from a disagreement over who pays in small claims court between individuals.

I’d be interested in this too. My ex is constantly threatening to take me to court and I’m worried about the same thing. Should I pay or should I take my chances?

If you pay the debt off within 30 days of judgement the CCJ can be removed from your credit file. You will need to write to the court to say you have paid and sent proof of payment from the person you owe money to.

If you pay the debt off after 30 days it will remain on your credit file. However, if you write to the court with proof of payment the file will be amended to show that the debt was "satisfied", so that people searching your credit record will see that you have paid.

You are not required to declare a CCJ when seeking credit or insurance unless specifically asked, but they may look at your credit record.

And yes, a judgement in the small claims court over a private disagreement is a CCJ.

If you don't owe him any money, don't pay just to avoid the possibility of a CCJ. Fight it and, if you lose, pay up within 30 days.

Correct. Once it is removed from your credit file your credit record is not affected.
