DUI/drink driving

Hi there,
So I just wanted some advice really. My partner, had been caught drink driving last week and is in court next month. Cut long story short, he left work and crashed he's car down a ditch and into a fence, he left it there and went to his mates to get some help but he was a bit shook up so he had a few beers, after he's drank he decided to try free the car from the Fence but as he started to drive from the scene he got flashed by a BMW police car. He didn't proceed to stop at first but then as he decided to slow down he got boxed in by 3 BMW police cars. He was arrested straight away and taken into custody. They breathalysed him and he blew 66 on the breathalyser test. He was release a few hours later and never interviewed.

I know he will probably loose his licence but I wanted to see if anyone had some advice.

He will get a band C fine (125%-175% of his relevant weekly income) and be disqualified for 17-22 months on the drink driving charge.

As it needed 3 police cars to stop him, he may also be charged with failure to stop. If he is, the penalties may be higher.

Oh heck op. Not stopping was a rash decision. My guess on close experience is a fine as previous poster predicts plus 18 month ban that could be reduced to a year if a driver rehab course is taken.
If there are any previous alcohol related offences or other convictions the ban could be longer. Best shot, hope you're not in court last and hope the judge is having a good day. I've been there as the one left doing all the driving....... Its a drain.

Isn't 66 incredibly high? Does he have a drinking problem?

Given that the highest category on the sentencing guidelines is for readings of 120-150 and above, I'm not sure I'd call 66 "incredibly high" but it is certainly well over the limit.

The limit is 35 in England and Wales.

I’ve watched enough Police Interceptor programmes to know that things have got pretty serious by the time three police cars are used to stop a suspect car. There has usually been some kind of chase or extended failure to stop by the time the other police cars are called for and arrive. Your description of your partner not stopping at first and then deciding to slow down sounds disingenuous. How far away from the scene of the accident did he finally stop? Could there be any dangerous driving offences? Was it bad luck that the police were there when your partner drove off or were they waiting for him because the crash had been reported by a passer by? Reading between the lines there seems more to this matter than a straightforward drink driving.

It's a bit of a coincidence that he crashed his car sober, then drank, then decided to extricate it. Then got caught.

I've heard of people drinking after a crash, with witnesses, then reporting it so they have an excuse for blowing over. Just saying. Although they normally don't start driving again!!!

Your DP's story is implausible and likely to be regarded as such in court. I suggest he gets legal advice and tells the truth, pleading guilty to any charges he is definitely guilty of.

Specifically what advice are you after.

He will most likely lose his license and have to attend mandated program where, hopefully he will be able to reflect on his bad decisions and choices and understand what led to these to prevent it from occurring again in the future.

It’s also best he admits his part in this and pleads guilt rather than carry on with the cock and bull story he currently has as it reflects badly on him.

I would advise him to cop to it and be remorseful. That story absolutely reeks of bullshit.

He should probably also get a solicitor and take advice from them.

It's unlikely that anyone will believe his story of having a few beers for shock and local cctv would be used to show the timings if he tried to stick with that story.
His absolute best course of action is to admit totally and utterly his guilt. Judges do take a more lenient approach where genuine remorse is shown. Signing up to an alcohol programme won't hurt him either but he will absolutely lose his licence and probably get a suspended sentence as well.
