Quick Q about commercial lease and suddenly appeared damp issue.

I've previously explained to Tennant about repairing lease etc, and issues are mostly for her to sort out. Returning to the property to getting ready for opening she's noticed a damp patch by the window. Very strange as she put a sealant on but reckons it's stills wet but seeks to be asking me to sort it?

It's a standard repairing lease is there anything usual about damp etc that would mean landlord gets involved?

Or where water

Depends entirely on the terms of the lease, you will need to see your solicitor and ask them to confirm once they've reviewed the lease.

Is there any term that would specifically preclude damp suddenly appearing?

Is that separate issues?

Solicitors moved on a long time ago.

Company charges a lot for lease to be looked at and dug out etc

The situation has now switched to a new window frame.

Rows anyone know the wording that would or wouldn't cover the window frames And what usual practise is

There is honestly no such thing as a standard repairing lease. It will depend on how the “premises” are defined (so that they include/exclude windows or frames), it will depend on the wording of the repair covenants, the service charge provisions, etc etc. Nobody here can give you the answer.

It does say property includes, paint, paper, internal plaster, the door and door frames window and window frames ,the whole of the shop front...

it also says replace any LL fixtures that become beyond economic repair during the term ...

the cross over part was damp on the wall - but if that is caused by the frame etc//
