Old Legal Files

Someone has accessed old family court legal files in order to harass members of my family, it's being done anonymously, although I have an inkling who it is, but obviously need evidence

Trying to put together a online paper trial for the police to look into -

This person may possibly may work in the legal industry, how would they request old legal files (2012ish) and would there be a record of them requesting/searching.

Same for civilians, where would they locate such files? Payment records etc

Thank you

Do you mean solicitor's file, or court file?

FelineFlick · 06/03/2021 21:14

I think family court files but could be either, all I know is that he has documents from that case, there's no way someone involved would of given him anything he is not related to anyone involved, he has just dug these files up in order to use them for no good.

Just to add to this to - the files are being used to impersonate someone else father and harass, the files are a family court maintenance case.

I can't say too much but it's really important I prove the documents were accessed as that's the only link.

Apologise for being a pest but anyone?

Is there a paper trail left when people request/pay/search.

Thanks in advance x

Well if a law firm had given the file to someone, yes. I don't imagine an employee would, if that's what you think has happened. Especially if the firm stores it's own archive.

But files are usually destroyed after 6 years.

No idea about Court files, I'm afraid.

Thank you MrsBB,

Trying to work out if Family Court Docs are considered public docs and therefore archived and available for order to the public. I've been reading around that non parties have been able to request court records, which is a little scary if that also counts towards family court docs.

Family Court files are not public documents and cannot be accessed by members of the public. The only way to get them is to be a party to the proceedings, a solicitor acting for a party to the proceedings (having properly filed a Notice saying as such to the court) or by Order of the Judge.

Solicitors files are destroyed after 6 years and solicitors will only give out their files to the client.

As others have said, we destroy them after 6 years unless we’ve been told to keep them for longer (law firms).

FelineFlick · 07/03/2021 18:20

I've just rechecked dates and there was still work being done as late as 2015 (got complicated due to jurisdiction) so still accessible,

So I guess I could call to see if anyone has requested the file, or do I need police backing for that kind of disclosure? He is definitely not a party but does possibly work in law.

I don't want to say much apart from this isn't his first rodeo, he is sociopathic, but that alone won't stick and need some usable evidence.

It isn't your file, so they won't be able to tell you anything.

HasaDigaEebowai · 07/03/2021 19:13

I think you’ve been watching too many thriller/conspiracy movies

There isn’t enough information here to help you. You might be best to pay a solicitor to help, if you’re limited in what you can say here...

Is there any chance the other party to the maintenance agreement has given him the information?
