I hope you don't mind me asking you a question about separation agreements (I saw your advice on another thread but didn't want to barge in there). My husband and I had a separation agreement drawn up in the summer. We wanted to do it now rather than wait for the divorce in two years and he wouldn't leave without being paid off. He has signed the house over to me, I've given him money. He has a charge on the house so if I die or sell he gets some more money. Both sides had a solicitor, the negotiations went back and forth several times.

My question is, when we come to divorce, can he go back on what was in the separation agreement and ask for more in the consent order, or will the agreement in the SA stand?

Provided the deed was negotiated paying due regard to the requirements set out in the case of Radmacher and Versteegh cases then it should be sound.

Thanks @Collaborate, I have no idea. I'm assuming the solicitors would have ensured that was the case. Thank you for your reply, I'll Google it
