NHS Review Panel Hearing

Background :- late DD was ill & cared for at home by a commercial company. Fees were in the region of £1000 per month.
NHS "Continuing care" was eventually granted from 2013 until his death in 2014, & his estate received a refund.

Accidentally posted.
I engaged a solicitor long before his death on a 30% basis. No problem with that - it saved me a lot of hassle.
There is now a Review Panel Hearing to appeal against the original date.
Sol. is trying to insist that I attend the 'phone hearing.
I don't want to. Do I have to? Or is Sol being unreasonable (i.e. a lazy wanker).

If you don't go you it could reduce your chances of success. Listen to your solicitor.

Thanks for the reply.
I realise I didn't make it clear, but Sol wants me to attend instead of him.
He stands to gain £8k if we win the appeal - as well as his cut of the earlier sum awarded. I really don't want to put myself through that ordeal as he is being paid to deal with it.

That's different. I would question that. Look at the terms you have agreed with him. Assuming he is supposed to represent you at the hearing you should insist on a reduction in his fee for winning if he refuses to do so.

Thanks again.
I suspect the real issue is that my original solicitor left the company.
He is very senior, & reading the profiles of their staff he is the specialist in this area, & CBA to read through all the documents.

I've taken on board what you've said, but if he does refuse to attend we could both lose out. I'll give him every chance to change his mind before I mention the Legal Ombudsman.
